FairWhistle, Inc. ("FairWhistle," "we," "our," or "us") respects your privacy and is committed to protecting personal information entrusted to us. This Privacy Policy explains how we collect, use, disclose, store, and protect personal information when you access or use the FairWhistle websites, applications, platforms, messaging tools, analytics, integrations, and related services (collectively, the "Services").
This Privacy Policy applies to referees, officials, coaches, referee coaches, administrators, league representatives, parents or guardians, and other users of the Services ("Users").
If you do not agree with this Privacy Policy, please do not use the Services.
1. Collection and Use of Personal Information
We collect personal information to operate, maintain, improve, secure, and support the FairWhistle platform; to enable referee feedback, rankings, communications, and reporting; to comply with legal obligations; and to protect users and platform integrity.
We collect personal information: directly from you when you create or manage an account, submit feedback, send messages, or communicate with us; automatically through your use of the Services; from Customers (leagues, associations, governing bodies, or organizations) that provision or manage your account; and from third-party integrations you authorize. We do not sell personal information.
2. Personal Information We Collect
Depending on your role and use of the Services, we may collect:
Identifiers and Account Information
name, username, email address, phone number; role (referee, coach, administrator, etc.);
organization, league, or association affiliation. Platform Activity and Content referee evaluations, rankings, performance indicators;
written feedback and assessments; in-app messages and communications;
uploaded documents or files. Technical and Usage Data IP address, device identifiers, browser type;
log data, timestamps, feature usage, and analytics. De-identified and Aggregated Data
anonymized performance metrics; aggregated reporting and benchmarking data; AI training data that does not identify individuals.
3. Feedback, Rankings, and Public Visibility
FairWhistle supports public and private rankings, evaluations, and reports as configured by Customers. Customers control what information is visible publicly, internally, or privately. Where feasible, FairWhistle de-identifies feedback and may use AI tools to rewrite or summarize feedback to promote constructive, professional tone. De-identified or aggregated data may be used for analytics, benchmarking, and product improvement.
4. In-App Messaging and Communications
The Services may include messaging between coaches, referee coaches, leagues, administrators, and officials. Messaging content is associated with user accounts and organizational context. We may access, preserve, or disclose messaging data when reasonably necessary to: investigate harassment or safeguarding concerns; comply with legal obligations; enforce our Terms of Service; protect users or platform security.
5. Artificial Intelligence and Automated Processing
FairWhistle uses AI-assisted tools to:
summarize feedback; rewrite feedback to promote constructive language; generate aggregated insights and reports.
AI outputs are informational only. We do not use automated decision-making to make legal, employment, or disciplinary decisions. Customers remain responsible for all decisions affecting referees or officials.
6. Third-Party Integrations
The Services may integrate with third-party platforms, tools, or APIs (such as scheduling, analytics, or identity systems). When you authorize an integration, relevant data may be shared with that third party subject to their own terms and privacy policies.
FairWhistle is not responsible for third-party privacy practices.
7. Data Storage and Security
FairWhistle follows security practices aligned with SOC frameworks. All data is encrypted at rest and in transit. We maintain administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure. Users acknowledge and accept inherent risks of online systems.
8. Disclosures to Third Parties
We may disclose personal information to: Customers that manage or administer your account; service providers supporting hosting, security, analytics, messaging, or customer support; legal or regulatory authorities when required by law; professional advisors in connection with audits or compliance; successors in the event of a merger, acquisition, or corporate transaction. We do not disclose personal information for third-party marketing purposes.
9. Children and Minors
FairWhistle does not knowingly collect personal information from children under the age of thirteen (13) without verified parental or guardian consent. Users under eighteen (18) may only use the Services with parental or guardian permission. Customers are responsible for obtaining and maintaining required consents and for compliance with youth safeguarding and child protection laws.
10. Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Services, maintain sessions, analyze usage, and improve performance. You may control cookies through your browser settings; however, disabling cookies may limit functionality.
11. Data Retention
We retain personal information only as long as reasonably necessary to: provide the Services; comply with legal obligations; resolve disputes; enforce agreements; and maintain platform integrity. We may retain de-identified or aggregated data indefinitely.
12. Confidentiality and Access Controls
Access to personal information is limited to authorized personnel and service providers with a legitimate business need. Customers configure user access, permissions, and visibility within the platform.
13. U.S. State Privacy Rights
Residents of certain U.S. states (including California, Colorado, Connecticut, Virginia, and Utah) may have rights regarding their personal information, including the right to: access personal information; correct inaccurate information; request deletion;
opt out of certain data processing. FairWhistle does not sell personal information or use it for cross-context behavioral advertising.

14. International Users
FairWhistle is based in the United States. By using the Services, you understand that your information may be processed and stored in the United States.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Material changes will be posted on our website. Continued use of the Services constitutes acceptance of the updated Privacy Policy.
